Terms and conditions of prize draw
1. Definitions Customer: any customer of the Promoter. Goods: the bathroom suite and associated products and Services purchased by the Customer as shown on their contract agreement. Main Prize: the reimbursement of the cost of purchase of the Goods and Services (up to a maximum value of £8,000). Promoter: The promoter is Mobility Plus Limited (CRN: 05522263) of Independence House, 14 Burdon Way, Stokesley Business Park, Stokesley, TS9 5PY. Qualifying Conditions: the purchase of the Goods and Services by the Customer and receipt by the Promoter of the full cost of the Goods. Runner-Up Prizes: High Street vouchers (or equivalent) to the value of £250. Services: includes installation, project management and disposal. 2. Eligibility to Enter 2.1. The prize draw is open to all Customers who are resident in the UK (except Northern Ireland) and aged 18 years or over except employees of the Promoter, their families, agents or any third party directly associated with administration of the prize draw. 2.2. Please note that the prize draw is not available to Customers resident in Northern Ireland. 2.3. Customers will be automatically entered into the draw following the satisfaction of the Qualifying Conditions. 2.4. The Promoter reserves all rights to disqualify the Customer if their conduct is contrary to the spirit or intention of the prize draw. 3. How to Enter 3.1. Entry to the prize draw is automatic on the satisfaction by the Promoter of the Qualifying Conditions. 3.2. There is a limit of one entry per installation (subject to satisfaction of the Qualifying Conditions). 3.3. The opening date for entries is midnight on 1st May 2017. The prize draw will continue on a monthly basis. The closing date in each month is the last day of the month. Any Customer who meets the Qualifying Conditions after this time will be entered into the following draw. 3.4. The Promoter reserves the right to withdraw the prize draw at any time. Any Customers that have satisfied the Qualifying Conditions and have not been included in a draw will be included in a final draw set by the Promoter. In the event of this happening, all Customers who fall into this category will be notified as soon as possible. 3.5. Unless the Customer informs the Promoter otherwise, if the Customer meets the Qualifying Conditions set out above, they will be entered into the draw automatically. 4. The Prize 4.1. There is one Main Prize available to be won per month, until such time that the Promoter withdraws the Prize Draw. 4.2. There are 4 Runner-Up Prizes available to be won per month, until such time that the Promoter withdraws the Prize Draw. 4.3. Prizes are subject to availability. There is no cash alternative for the Runner-Up Prizes and the winner of the Main Prize will receive a cheque for the value of their Goods and Services to a maximum value of £8,000. Should the winner’s Goods and Services have cost less than the maximum value, there is to be no top-up cash alternative available. 4.4. Your chance of winning depends on the number of Customers who meet the Qualifying Conditions in the month preceding the draw. 5. The Winner 5.1. A winner will be chosen by random draw supervised by an independent person in the first week of each month until the draw is withdrawn by the Promoter (“Draw Date”). 5.2. The selected entry winners are final. In the event of any dispute regarding the prize draw the decision of the Promoter will be final and binding and no correspondence or discussion will be entered into. 5.3. The winners of both the Main Prize and the Runner-Up Prizes will be notified by email or telephone (using details provided upon purchase) as soon as practicable after the announcement. If a winner does not respond to the Promoter within 14 days of being notified by the Promoter, then the winner’s prize will be forfeited and the Promoter will be entitled to select another winner in accordance with the process described above. 5.4. The Main Prize will be provided to the winner by cheque within 30 days of being notified of their win. 5.5. The Runner-Up Prize winners will receive their prize within 30 days of being notified of their win. 5.6. The prizes for the winners are non-exchangeable, non-transferable and no cash alternative is offered. 6. Further information 6.1. The decision of the Promoter regarding any aspect of the prize draw is final and binding and no correspondence will be entered into about it. 6.2. The winner’s name and county can be obtained by sending a stamped addressed envelope or e-mail to the Promoter from the date of the announcement of the prize draw for a period of 30 days, or by consulting the dedicated page on the Promoters website https://www.mobility-plus.co.uk/draw/. 6.3. Participants are deemed to have accepted and agreed to be bound by these terms and conditions upon entry. The Promoter reserves the right to refuse entry, or refuse to award the prize to anyone in breach of these terms and conditions. 6.4. The Promoter reserves the right to hold void, cancel, suspend, or amend the promotion where it becomes necessary to do so. Any change will be notified on the Promoters website https://www.mobility-plus.co.uk/draw/. 6.5. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. The Customers statutory rights are not affected. 6.6. Winners are required to participate in publicity related to the prize draw which may include the publication of their name, county and photograph in any media. 6.7. Personal data supplied during the course of this promotion may be passed on to third party suppliers only insofar as required for fulfilment/delivery/arrangement of the prize. 6.8. The prize draw will be governed by English law and entrants to the prize draw submit to the jurisdiction of the English courts.
